By placing an order for goods, you are entering into a contract with Trent Ashley Eacott trading as MoFro Wines ABN 50398869106 for the purchase and sale of goods.
You may use the MoFro Wines website or other means of communication with MoFro Wines to place an order for goods. The contract between you and Mofro Wines only takes affect once MoFro Wines accepts your offer to purchase goods (your order). Each order you place shall constitute a separate contract. Orders cannot be cancelled unless by mutual agreement in writing with MoFro Wines.
Secure Online Payments
You must pay for your goods before MoFro dispatches your order. MoFro Wines use PayPal to process your credit card payment. Your complete credit card number cannot be viewed by MoFro Wines or any outside party. We never permanently store complete credit card details on site. MoFro Wines holds a Producer Wholesaler Licence under the New South Wales Liquor and Gaming Authority, License Number – LIQW880014576. MoFro Wines is required to ensure an audit trail exists to identify the purchase and sale or supply of liquor, and no liquor is to be sold or supplied to a minor.
Returns and Claims
Claims for broken or damaged goods must be reported within 24 hours of delivery, so make sure you check your order as soon as you receive. Requests for returns for credit or exchange must be made within 7 days.
Risk and title to the goods passes to you upon delivery of the goods provided they are not damaged when they are delivered to your nominated delivery address.
MoFro Wines uses the specialized wine delivery network at Australia Post to deliver your goods. This service requires a signature upon delivery for security purposes. If you choose to have the goods delivered to your home or business and you are out when the delivery is attempted, a card will be placed in your letterbox and your package will be securely stored at your local post office for collection. The post office keeps your parcel for a maximum of 14 days.
Alternatively, during the checkout process you can elect to have your wine left at the delivery address in a specific location ie, under the verandah, behind the side gate etc, if no one is home. Doing so removes the requirement for a signature and passes on responsibility to you for any issues that may occur post delivery such as damage or theft.
Delivery can take up to 10 working days, but this time frame can be shorter depending on the overall pressure on the delivery network at that particular time, your distance from major centres and product availability.
By placing an order with MoFro Wines you agree to receive correspondence from us including but not limited to information as it relates to your purchase(s) along with promotional material as we see fit to conduct the normal course of our business. In the case of promotional correspondence, you are free to unsubscribe from this free service at any time.
Limitation of Liability
Nothing in this contract is to be interpreted as having the effect of excluding, restricting or modifying any condition or warranty, or right or liability implied by any applicable legislation into the arrangement between MoFro Wines and you, if such exclusion, restriction or modification would be void or prohibited by the legislation.
To the extent that MoFro Wines breaches any condition or warranty implied into the contract with you which cannot be excluded or modified, MoFro Wines’ liability is limited to, at MoFro Wines’ discretion, either the replacement of the goods or supply of equivalent goods, or the payment of the cost of replacing the goods or acquiring equivalent goods.
Subject to the foregoing, MoFro Wines is not liable to you (or to any third party claiming through you) for, and you release MoFro Wines from, any loss, liability, damage, expense or cost whatsoever and includes (without limitation) indirect or consequential loss or damage, loss of profits or business opportunity, and damage to equipment or property caused by any act or omission of MoFro Wines, its employees or agents, and whether based on negligence or other tort, contract or otherwise.
